Description

The judicial process occupies a central position in every constitutional democracy because it acts as the mechanism through which law is interpreted, rights are protected, and justice is administered. In India, the judiciary has historically played a transformative role in balancing individual liberty with societal interests and maintaining constitutional supremacy. The concept of judicial process extends beyond the mere application of statutes by courts; it includes judicial reasoning, interpretation, adjudication, and the creative role played by judges in evolving legal principles according to changing social realities. The Indian judicial system, founded upon the principles of rule of law, constitutionalism, and separation of powers, has continuously adapted itself to meet the demands of an evolving society. The judiciary therefore functions not only as an interpreter of law but also as a guardian of constitutional values and fundamental rights.

In this background, Savitribai Phule Pune University revised its curriculum on the basis of Choice Based Credit System for LL.M from the academic year 2025-26 and introduced Judicial Process as one of the compulsory papers consisting of four credits under the specialization of Constitutional and Administrative Law. As an introductory perspective to prod and provoke the inquisitiveness of students, to grasp the key features of judicial process and their relevance in a subtle perspective, and to provide help for the preparation of various university examinations providing for Judicial Process as a subject, the author designed its contents completely on the basis of the syllabus issued by the university, attempting to make available every point in one book.
